Jumuˋah prayer in the homes in cases where it is prevented from [being prayed] in the mosques

Praise be to Allāh, and peace and blessings upon our Prophet Muḥammad, [all] the Prophets, and those who followed them. As for what follows:

Whoever contemplates the explicit sunnah found under this chapter heading will know that there is no explicit text stipulating a specific number [of people] for establishing the Jumuˋah prayer, nor stipulating a specific place.

Indeed, some of the people of knowledge held the opinion that the Jumuˋah prayer can be held with two people or more.

If the congregational prayer is valid with one person along with the imām, then the Jumuˋah prayer is a prayer from amongst the prayers; so whoever stipulates for it more than what allows for a congregation to be held must provide the evidence.

The majority of the imams held the opinion that it is permissible to perform the Jumuˋah anywhere and did not stipulate that it had to be established in the mosque, as there is no evidence reported for stipulating the mosque for [the validity] of its prayer.

It seems clear then, that it is permissible to perform the Jumuˋah prayer in the homes during times of necessity, including general epidemics.

Abū Dāwūd said,

“I heard Aḥmad say, ‘Al-Madīnah, was approached by Muṣˋab ibn ˋUmayr and they were hidden in a home, so he held the Jumuˋah with them, and they were forty.’”

Ibn Qudāmah said,

“And for us, it is a prayer within which is legislated a gathering and a sermon, so it is permitted wherever it is needed from amongst the places”

(Al-Muġnī 2/248).

And the Jumuˋah prayer, though it may not be obligatory on those who are required [to pray it] in the mosques to safeguard lives, it is, however, permitted to establish it in the home to ensure the illness is not transmitted and spread amongst those who are praying. The opinion that it is not obligatory does not mean that it is not valid for the one who prays it.

A matter remains: What if a person does not pray the Jumuˋah prayer in home and he prayed it as the Ṭhuhr prayer?

Answer: The person has that right, for the matter does not have within it what compels the obligation for praying the Jumuˋah prayer in the home.

This is from the matters wherein ijtihād [the exercise of judgement] is permitted. And Allāh knows best and is the Wiser.

صلاة الجمعة في البيوت في حال امتناعها في المساجد

الحمد لله والصلاة والسلام على نبينا محمد والنبيين ومن تبعهم وبعد:

من تأمل السنة الصريحة الواردة في هذا الباب، علم أنه ليس هناك نص صريح في اشتراط عدد معين لإقامة الجمعة ولا اشتراط مكان معين.

وقد ذهب بعض أهل العلم إلى أن الجمعة تنعقد باثنين فصاعدا.

واذا كانت صلاة الجماعة تصح بواحد مع الإمام، فصلاة الجمعة هي صلاة من الصلوات، فمن اشترط فيها زيادة على ما تنعقد به الجماعة لزمه الدليل.

وذهب جمهور الأئمة إلى جوازِ أداءِ الجمعة في أيّ مكان، ولم يشترطوا لإقامتها أن تكون في المسجد، إذ لم يرد ما يدل على اشتراط المسجد لصلاتها.

فالذي يظهر أنه يجوز أداء صلاة الجمعة في المنازل في زمان الضرورات ومنها الأوبئة العامة.

قال أبو داود: سمعت أحمد يقول: المدينة، قدمها مصعب بن عمير وهم مختبئون في دار، فجمع بهم وهم أربعون.

وقال ابن قدامة ولنا: أنها صلاة شُرع لها الاجتماع والخطبة، فجازت فيما يحتاج إليه من المواضع… المغني (2/ 248)

والجمعة وإن كانت لا تجب على المكلفين في المسجد حفظا للأنفس، لكن يشرع إقامتها في المنزل لأمن انتقال المرض وانتشاره بين المصلين، والقول بأنها لا تجب لا يعني أنها لا تصح ممن صلاها.

بقي أمر ماذا لو لم يصل من في البيت الجمعة وصلاها ظهرا؟

والجواب: له ذلك فإن الأمر ليس فيه ما يلزم بوجوب الجمعة في البيت.

وهذه من المسائل التي يشرع فيها الاجتهاد. والله تعالى أعلم وأحكم.
